@Pwnallthethings@mastodon.social Yeah, the plausibly-relevant regulation for some subset of jobs is NISP, but that’d be a “don’t apply for this job if you don’t have (or can’t get) a security clearance” situation and wouldn’t need to be even implicitly about foreign nationals from the SpaceX perspective (since there are lots of Americans who can’t get clearances and it isn’t the company’s job to care about the specific reason/regulation preventing them).

@Pwnallthethings@mastodon.social I’m not an expert on all the nuances, but aren’t export controls driven entirely by the product (or its components)? I’d have said a company could employ basically anyone (provided they’re legally employed, maybe?) and export controls wouldn’t weigh in on that (even if other regulations/programs, like NISP, might).
