(1) You applied to any job (not just engineers) at SpaceX but were rejected
(2) You were discouraged from applying to SpaceX because you were not a citizen or permanent resident
(3) A recruiter or SpaceX employee told you that they could only hire citizens/permanent residents.

The long story short is that:
1) Not-guilty / not-elected: goes home
2) Not-guilty / elected: goes to WH
3) Guilty / not-elected: goes to prison
4) Guilty / elected: goes to WH.
On (4) the exact process is dependent on which exact cases he's found guilty on. But while the process changes, the outcome is the same.
