A.M.A.S. has demonstrated a quintessential violation of the individual rights protected in the first ten amendments to the U.S. Constitution, the Bill of Rights passed immediately upon the founding of the United States. This is what has the judge so firmly against ICE’s treatment of A.M.A.S. The judge also takes a swipe at the Roberts Court’s shadow docket ruling, calling it an “unreasoned order staying a class-wide preliminary injunction.” 8/

In a nutshell, the judge says that D.V.D. is a class action and involves questions about whether an entire class can assert due process and related claims. In September, the plaintiff filed a new complaint alleging that his removal to Equatorial Guinea with no notice and therefore no opportunity to assert credible fear of persecution there violated his federal constitutional right to due process. He also made some other, related claims. He asked the court to order the Trump regime to get him back to the U.S. Today, the trial judge ordered that relief. 6/

The judge also rejected the Trump regime’s argument that diplomatic assurances from Equatorial Guinea that it would not mistreat people sent there substitutes for an individual’s right to be given notice of removal to a 3rd party country and an opportunity to show credible fear.
