First take: I think Justice Gorsuch reached the right outcome on the scope of § 1 of the FAA in Brock as the case was argued, but it might be the wrong outcome if we focus on Brock's status as a distributor/franchisee. Some Costco customers are suing Costco, claiming entitlement to a portion of the refunds that the company is seeking from the government on its tariff claims. Seems like a stupid suit. Costco never promised refunds, so plaintiffs have no legal claims. Moreover, Costco hasn’t recovered anything yet. As a result, unlike the mangoes in the nectar that I buy from Costco, I think this claim is unripe.
